WARNING. You or any player in any sport can sustain a head injury with even the very best head protection. Unequal pads cannot prevent concussions or eliminate the risk of serious head or neck injuries. Scientists have not reached agreement on how the results of impact absorption tests relate to concussions. Independent third party accredited lab tests of Unequal supplemental head pads, headbands and body pads (the “Unequal Product” and collectively referred to as “Unequal Products”), showed a reduction of the Severity Index and G-Force in most cases. Results may vary depending on: helmet or pad type & style; sport / activity; contact surface; temperature; impact levels; linear & angular forces; helmet or pad manufacturer; and user’s health. No helmet or padding, including Unequal Product(s), can prevent serious head, brain, body and/or neck injuries including paralysis or death a person might incur while participating in activities, games, or sports. Do not butt, ram, spear, or strike an opposing player. Contact with a person, object, surface, or projectile can result in severe head, body or neck injuries, paralysis or death to You and possible injury to your opponent. This contact may result in concussion- brain injury or severe bodily injury, which no helmet or body pad can prevent. Symptoms of such injuries include: loss of consciousness or memory, confusion, bruising, redness, dizziness, headache, nausea, pain, soreness, discoloration, numbness or tingling. If You have any of these symptoms, immediately stop playing and report them to your coach, trainer, and/or parents. Do not play or return to the activity, sport, game, or practice until all symptoms are gone and You have received medical clearance. Ignoring this WARNING may lead to another and more serious or fatal injury. Unequal Product(s) are not bullet proof, bullet resistant, stab resistant, or stab proof. Remember helmets and body pads do have limitations. They are your second line of defense. Obey the Rules and Code of Conduct of your particular sport, game or activity. Being careful and responsible is your first priority. Use common sense and practice safe sports.
DISCLAIMER: Unequal reduces concussion risk, compared to no head protection. Leading medical doctors, PhD’s and scientists have concluded that a reduction in acceleration correlates with a reduction in concussion risk. Any player in any activity, game, or sport, can sustain a head injury even with head protection, and that no helmet, pad or Unequal product can prevent concussions or eliminate the risk of these injuries. Unequal head protection products have not been evaluated by the FDA. These Head Products are not intended to diagnose, treat, cure, or prevent any disease.
Release And Waiver Of Claims Agreement. In regard to use of any Unequal Product(s), I, the purchaser of and/or the user of the Unequal Product, or if the registered user is a minor, then the registered user’s parent or legal guardian (collectively referred to as “You”), represent that one or both of You are over the age of eighteen (18), and that You have read and understood the entire WARNING and will act accordingly. Further, You hereby agree to the fullest extent permitted by law as follows: (i) You acknowledge and represent that how the Unequal Products will perform or protect is unknown, and they are not implied or expressly warranted to protect You from any degree of contact or impact; (ii) You acknowledge that sports involve certain risks, dangers and hazards which can result in serious personal injury and death, as such, You hereby freely agree to assume and accept any and all known risk of injury; (iii) You waive any and all claims that You might have or may have in the future against Unequal Technologies Company, its associates and affiliates (collectively referred to as “Unequal”); (iv) Except for the Warranty stated herein, You release Unequal from any and all liability for any loss, damage, injury, or expense that You may suffer, or that your next of kin may suffer, as a result of using any of the Unequal Products due to any cause whatsoever, including negligence, and/or a breach of contract regarding the manufacture, installation, performance, use, or adjustment of any Unequal Products. You understand fully that this is a warranty and disposition of the disputes both as to the legal liability for said accident, casualty, or event and as to the nature and extent of the injury, illness, disease and/or damage which You have sustained and You understand that liability is denied by Unequal and it is covenanted and agreed between You and Unequal that this release and warranty is not to be construed as an admission of liability on the part of Unequal; that this release and warranty shall not be used by You or any one on your behalf as a defense or estoppel in any action which is now pending or may be brought hereafter by Unequal against You or your agents and servants, and any claim of whatever kind or nature Unequal might have or hereafter have arising from said accident is expressly reserved to them. In the event that any provision of this Release is determined to be invalid, unenforceable or unlawful, such invalidity, unenforceability or unlawfulness shall not affect any other provisions of this Release, and the Release shall be construed as if the challenged provision had never been contained herein.
